SECTION 1. PURPOSE.

The purpose of this Revenue Procedure is to provide information to all bottlers of distilled spirits concerning section 5.2 of the Regulations relating to the Labeling and Advertising of Distilled Spirits. That section provides that the requirements contained in such regulations as to size and filling of bottles are extended to and made a part of the Regulations relating to Traffic in Containers of Distilled Spirits.

SEC. 2. CONTAINERS OF A CAPACITY OF LESS THAN ONE-HALF PINT.

The provisions of section 5.2 is not applicable to containers of a capacity of less than one-half pint. A `container,' as defined in section 175.11 of the Regulations relating to Traffic in Containers of Distilled Spirits, is a vessel of a capacity of not less than one-half pint and not more than five wine gallons, designed or intended for use for the sale of distilled spirits for other than indeustrial use.

SEC. 3. DISTILLED SPIRITS CONTAINERS SUBJECT TO THE STANDARDS OF FILL.

Distilled spirits which are subject to the standards of fill prescribed in section 5.73 of the Regulations relating to the Labeling and Advertising of Distilled Spirits, i.e. , one gallon, one-half gallon, one quart, four-fifths quart, one pint, and one-half pint, and for Scotch and Irish Whisky and Scotch type whisky and for brandy and rum, four-fifths pint, may not be packaged in other size containers under certificates of examption from label approval, regardless of whether or not they are permitted by the laws and regulations of the state in which the sale of such distilled spirits would be made.

SEC. 4. TERMINATION OF IMPROPER PACKAGING.

Appropriate steps are being taken to terminate the improper packaging of distilled spirts by any permittees who have undertaken such operations because of their unfamiliarity with existin regulations.

Inquiries in regard to this Revenue Procedure should refer to the number thereof and to the symbols: O:AT:BP.

SEC. 6. EFFECTIVE DATE.

The information contained in this Revenue Procedure was transmitted to persons concerned on June 11, 1956, by Industry Circular No. 56-23. Accordingly, this Revenue Procedure is effective on that date.
